A man who was in prison for possessing child abuse material was charged with allegedly sexually abusing a 14-year-old girl in a playground bathroom.

Detectives from the NSW Police Child Abuse Unit began their investigation after the girl reported that she had been sexually assaulted by an unknown man at Pole Depot Park in Penshurst on Monday morning.

The young girl was allegedly led into a playground bathroom by the 46-year-old man who is subsequently accused of attacking her, 7 News reported.

NCA Newswire has confirmed that the man was in prison from May to August last year after being convicted of possessing child sexual abuse material.

Despite his conviction, the man understands that, given the short length of his prison sentence, he was allowed to live near the playground as he was automatically released on parole after his release.

Police set up a crime scene in Penshurst Park before their investigation led them to a nearby house where they arrested the 46-year-old.

He was taken to Kogarah Police Station and charged with five offences, including producing child abuse material, aggravated sexual intercourse with a child aged over 14 and under 16, and using a child aged over 14 to produce child abuse material.

He was refused bail to appear before Sutherland Local Court on Tuesday, where he was formally refused bail to appear in court in October.
