The owner of a North End restaurant accused of shooting a man outside a popular bakery last summer was arrested again over the weekend after allegedly trying to cut through the electronic monitoring device attached to his body, police said.

Patrick Mendoza, 55, exhibited “erratic behavior” before attempting to cut through the mandatory device on Saturday night, according to a redacted Boston police report, which said Mendoza was “extremely stressed” because of the criminal case pending against him.

“Officers recovered Mendoza P.’s electronic monitoring device from his home, which appeared to have been cut,” the police report states. “Officers asked Mendoza P. why he had cut the bracelet, and he responded, ‘I’m tired and fed up with it.'”

“During the admission, Mendoza P. also stated that he was (redacted) and ‘will definitely kill someone,'” the report continues.

The report states that Mendoza was arrested on a warrant charging him with armed assault in the nature of murder, attempted assault with a firearm, unlawful possession of a firearm without a permit and possession of ammunition without a firearm identification card. The arrest occurred at 31 N. Bennett Street, a different address than the home address listed on the document.

His arraignment was scheduled for Monday in Suffolk Supreme Court.

The charges stem from a July 12, 2023, shooting outside the Modern Bakery on Hanover Street, a popular North End spot.

Mendoza, whose family owns Monica’s Trattoria, is accused of firing three shots at a man with whom he was in a long-term relationship. The defendant had previously struck the same man in the head with a glass bottle in 2019, for which he received six months probation, the Herald previously reported.

He was arrested nine days after the shooting.
