In Seremban, a man receives 20 years in prison and five strokes for raping his daughter since she was 12

SEREMBAN, May 8 – A man was sentenced to 20 years in prison and five lashes by the Sessions Court here today after pleading guilty to raping his daughter from the age of 12 until birth.

While sentencing the 44-year-old man, Judge Mohamad Kamil Nizam said that the offense committed by the accused was a serious crime.

He said his daughter was traumatized by the defendant’s actions and suffered a severe psychological scar.

“As a father, it is your job to take care of your children, but you have done the opposite. I am aware that the victim filed a complaint after her parents were arrested by the police in another case… the victim must have done it.” “I felt unsafe staying at home during that time,” he said .

According to the indictment, the man was accused of having sexual intercourse with his 18-year-old daughter in a village in Port Dickson on November 2, 2022, under Section 376B (1) of the Code, which carries a minimum sentence of 10 years and a maximum of 30 years and flogging.

Based on the facts of the case, the victim reported to the police that she was raped by the accused when she was 12 years old until April 21.

The teenager did not report the matter to anyone until her mother and the accused were arrested in a narcotics case, which prompted the complainant to file a police report on May 1.

The complainant suspected that she was pregnant in December 2022 and gave birth to her child in a hospital on August 17, 2023. The defendant and the complainant’s mother handed the child over to someone else without the complainant’s knowledge.

The unrepresented father of four had previously requested a lighter sentence on the grounds that he had a small child and a wife who suffered from health problems.

Deputy public prosecutor M. Kalaivaanan requested the court to sentence him to long imprisonment and flogging as the offense committed by the accused was a serious criminal case.

Meanwhile, the accused and his 45-year-old wife were jointly charged in another sessions court for possession of drugs, suspected to be Yaba pills weighing 32.83 grams.

They are accused of having committed the offense at 2.30 a.m. on April 28 at the same place under Section 12(2) of the Dangerous Drugs Act 1952 and may be punished under Section 39A(2) of the same Act which provides for a sentence of life imprisonment or a prison sentence of at least five years and flogging.

The defendant pleaded guilty but his wife pleaded not guilty when the charges were read out before Judge Meor Sulaiman Ahmad Tarmizi.

The case was handled by Deputy Public Prosecutor Syamimi Farhana Muhammad A Aziz while the accused was not represented by a lawyer. The court set July 4 for the case to be heard again. —Bernama
