MCAO dismisses case against employee accused of sexual abuse in care facility

The Maricopa County Attorney’s Office has dropped a lawsuit against an employee who allegedly raped and impregnated a patient at a long-term care facility.

During a press conference on Wednesday, District Attorney Rachel Mitchell said the case, filed by Goodyear police in February, was reviewed and dismissed by the agency because there was “not a reasonable likelihood of conviction.”

Mitchell said there were “evidence issues” in this case.

In a statement released Thursday, Goodyear police said the department conducted a “comprehensive investigation” before referring the case to the MCAO. The charges presented to the MCAO included sexual assault and false imprisonment.

The case involved an employee at Palm Valley Post Acute Care Facility who surrendered his certified nursing assistant credential after the allegations were made against him.

ABC15 later found out that the facility was facing charges for not immediately reporting the alleged abuse to the state.

Goodyear police investigated the case and filed charges, including sexual assault and false imprisonment.
