Trump Georgia case on hold pending appeal of Fani Willis ruling, court says – WSB-TV Channel 2

ATLANTA — The Georgia Court of Appeals has stayed the Georgia election interference case involving former President Donald Trump and 15 others accused of conspiring to overturn the 2020 election here in Georgia.

The ruling was issued Wednesday shortly after 4 p.m., suspending the case until the court resolves the appeal of Fulton County Superior Court Judge Scott McAfee’s ruling that Fani Willis could remain on the case.

The court is tentatively scheduled to hear the case from October 4.

Trump and other co-defendants filed a motion to remove Willis from the case because of his relationship with special prosecutor Nathan Wade.

Willis and Wade recognized the relationship, which they say ended last summer, but they argued that it doesn’t create any sort of conflict and has no bearing on the case.

Fulton County Superior Court Judge Scott McAfee ruled that Willis would be allowed to stay on the case if Wade withdrew. Wade resigned the same day as the decision.

Trump and his lawyers later appealed, arguing that the indictment should have been dismissed and that Willis and his team should have been disqualified from the case.

Legal experts previously said as the appeals court heard the case that Trump and the other co-defendants in the case would not be tried before the 2024 elections. This is now virtually guaranteed.

“Ultimately, the case is now completely settled. There’s nothing else the judge can do about it. The appeals court was going to take its time and decide whether Fani Willis should be disqualified, and also whether the charges dismissed by the trial judge should be reinstated,” attorney Manny Arora said. Mark Winne, Channel 2 investigative reporter.

Arora represented one of the defendants in the case who already has a plea deal. He says the court wants to make sure everything goes well.

“Everything has stopped because the Court of Appeal wants to explore this issue further. The issue of impeachment based on the underlying facts is somewhat new, as is the fact that the judge dismissed a few counts. The government will try to reintegrate them.

Trump’s Georgia lawyer, Steve Sadow, sent a statement saying:

“The Georgia Court of Appeals has rightly stayed all proceedings against President Trump in the trial court pending its ruling on our interlocutory appeal which contends that the case should be dismissed and County DA Willis Fulton should be disqualified for her misconduct.”

In a statement, the lawyer for Michael Roman, accused in this case, said:

“We are pleased that the Court of Appeal agrees with us that this issue is so important to this entire case that it has decided to block the case from moving forward in the trial court until “The question of whether or not Willis should be removed from the case can be decided. The Fulton County Prosecutor’s Office told Winne that the appeals court order speaks for itself, but confirmed that the court is hearing not only an appeal from defense attorneys, but also an appeal from the prosecutor’s office.
