Phoenix man arrested after indecent assault incident in Scottsdale apartment

Investigators in Scottsdale describe a rather unusual incident over the weekend that led to the arrest of a person.

The suspect, who already has a criminal record, is accused of several criminal offenses.

Who is the suspect?

Court documents identified the suspect as 49-year-old John Jospeh Chmielewski.

What happened?

Investigators say the incident occurred on the afternoon of June 2 at an apartment in the area of ​​McDonald Drive and Hayden Road in Scottsdale.

Police officers were called to the scene at around 5:13 p.m.

“The reporting officer stated that he offered the defendant water, at which point the defendant entered the reporting officer’s porch,” investigators wrote. “The reporting officer stated that he locked his back door to prevent the defendant from entering and began to tell the defendant that he needed to leave.”

Chmielewski, police said, refused to leave and later took off his pants. Chmielewski later left the porch and walked toward a green space in the area, where the man who called police said he saw Chmielewski engaging in a sexual act.

“Upon arrival, I observed the defendant standing in the greenbelt near the reporting officer’s porch, yelling indiscriminately and disobeying officers’ commands,” a police officer wrote in court documents. “The officers then resorted to physically restraining the defendant to the ground due to his combative behavior. The defendant continued to kick his legs and make incomprehensible statements while handcuffed.”

When police later searched Chmielewski’s property, they found narcotics and drug paraphernalia left on the porch.

According to court documents, Chmielewski is charged with illegal possession of narcotics (ARS 13-3408A1), illegal possession of drug paraphernalia (ARS 13-3415A), disturbing the peace (ARS 13-2904A1), public sexual lewdness (ARS 13-1403A1) and third-degree trespassing (ARS 13-1502A1).

According to investigators, Chmielewski had previously been arrested for drug offenses.

Bail was originally requested at $25,000, but the judge ultimately set bail for Chmielewski at $1,000. If he posts bail, he will be subject to a number of conditions, including being barred from returning to the scene of the alleged crime and having no contact with one or more of the alleged victims.

A preliminary hearing is scheduled for June 12.
