Liability for MTA bus accidents

Buses are usually very safe for passengers. However, they pose a number of dangers for pedestrians and passengers in smaller vehicles. According to The Journalist’s Resource, “An average of about 63,000 buses (of all types) are involved in an accident each year; about 14,000 of these result in injuries and 325 deaths. On average, about 50 passengers (including the driver) die each year.” Several factors can contribute to any bus accident.

  • Speeding
  • Inexperience of the driver
  • Poor road conditions
  • Drunk driving

All drivers are required by law to exercise due care to avoid collisions. Many accidents are the result of drivers making dangerous left turns. According to New York Vehicle Code 1141, “The driver of a vehicle attempting to turn left within an intersection or into an alley, private road or driveway shall yield the right of way to any oncoming vehicle that is within the intersection or is so close as to present an imminent danger.” Several steps should be taken after any bus accident.

  • Monitoring should be sought.
  • Photos should be taken of the accident scene.
  • Medical records should be kept.
  • An experienced bus accident lawyer should be contacted.

Buses can be difficult to drive even under the best of circumstances. These vehicles have large blind spots and bus drivers may not see other vehicles before a collision occurs. This is why it is so important that bus drivers are well trained. Numerous sources of liability can arise when a collision occurs. After any bus accident, it is important to consult with an experienced bus accident attorney who can review the particular facts of your case and advise you of your legal options.
