Liability for hit-and-run accidents in Queens

Hit-and-run accidents remain alarmingly common in the United States. According to the AAA Foundation for Traffic Safety, “There were an estimated 737,100 hit-and-run accidents in 2015 (NHTSA, 2016). That means a hit-and-run accident occurs somewhere in the United States every 43 seconds. The 2,049 hit-and-run deaths in 2016 were the highest number ever recorded (NHTSA, 2017).” Several factors can contribute to a hit-and-run accident.

  • Drunk driving
  • Speeding
  • Vehicle system failures
  • Reckless driving

All drivers are required by law to obey traffic laws and take steps to avoid collisions. According to New York Vehicle Code 1180, no person may drive a motor vehicle faster than is reasonable or safe given the prevailing road conditions. If a driver fails to slow down to avoid a collision, it may be the basis for a negligence claim. An investigation should be conducted after every hit-and-run accident.

  • Fragments of the fleeing vehicle are to be collected.
  • Eyewitnesses should be questioned.
  • Medical records relating to the death should be requested.
  • The bus driver’s logbook should be examined.

Hit and run accidents can be very traumatic for everyone involved. This is especially true if someone is killed in the accident. Evidence can help identify the driver who fled the scene of the accident, but it is important that it is collected quickly. The family of someone who died in an accident may be able to pursue legal action through a civil lawsuit. A wrongful death attorney can review all of the unique facts of your case and advise you of your legal options.
