Judge denies man bail for alleged kidnapping and rape of his wife

Municipal Judge Deserine Alleyne rejected a bail application for a St. Catherine businessman who allegedly locked his common-law wife in his bedroom for a week and raped and physically assaulted her.

Davian Smythe, 27, of Phoenix Park Village in Portmore, St Catherine, appeared in St Catherine Parish Court on Tuesday. He is due back on June 4.

Smythe is charged with rape, kidnapping by force, unlawful imprisonment, aggravated sexual assault, simple theft, common assault and battery after various incidents allegedly occurred in 2023 and earlier this year.

In October 2023, Smythe reportedly took the complainant to his home, where he locked her in his bedroom and then raped and assaulted her.

In April 2024, Smythe and the complainant got into an argument during which he allegedly repeated his attacks on her.

Among other things, he is said to have taken her cell phone and passport and tried to strangle her, which caused swelling and bruising to her neck.

She then escaped and reported the matter to Greater Portmore Police. Smythe was later arrested and charged.
