The problem with digital parking garage surveillance

Companies like Metropolis, Professional Parking Management and McKinley Payments manage parking garages in unconventional ways:

  • Open gates without security personnel: The garages remain open without people guarding the exits.
  • Payment via app: Signs instruct drivers to pay for parking via an app.
  • Camera surveillance: Cameras record vehicles entering and leaving the garage.
  • Information on violations: If you drive off without paying through the app, the companies will check your vehicle’s registration and send you a “violation notice” or similar penalty in the mail.

This practice is not only unusual, but potentially unfair and illegal for several reasons, including:

  1. Lack of consent: Leaving gates open and unattended does not indicate clear agreement by drivers to payment terms.
  2. Inadequate notification: Signs may not contain sufficient or clear information about the requirement to pay through the app, which can lead to confusion and unintentional violations.
  3. Violation of privacy: Accessing vehicle registration information to send violation notifications may constitute an invasion of privacy and misuse of personal data.
  4. Unfair billing practices: Sending violation notices by mail without express consent or notification may be considered an unfair and deceptive billing practice that is illegal under federal and state consumer protection laws.

Drivers across the country have complained to the Better Business Bureau and state attorneys general about these practices. Last year, for example, more than 66 complaints were issued in the state of Tennessee alone for unjustified parking tickets in Metropolis.
