Preliminary agreement reached in sexual assault case at private school in Flintridge

A tentative settlement has been reached in a lawsuit against Flintridge Preparatory School by a woman who claims she was sexually abused by a teacher, but a judge said he wants to know the actual status of the settlement and when a motion to dismiss will be filed.

The plaintiff, now in her mid-20s, is identified only as Jane Doe in the Los Angeles Superior Court lawsuit against the school and former teacher Edward “Toby” Wagstaff. She is accused of sexual harassment, intentional infliction of emotional distress, child sexual abuse, failure to report suspected child abuse, civil rights violations and negligence. In January, Judge Stephen P. Pfahler ordered a stay of the case so the parties could attend mediation.

On Tuesday, Doe’s lawyers filed court documents with Pfahler informing him of a “conditional” settlement in the case. A motion to dismiss is expected to be filed by Sept. 4. No terms were announced and the judge scheduled a status conference for Oct. 22.
