North Buffalo bar reopens following city cease and desist notice

BUFFALO NY (WIVB) – A North Buffalo bar that was closed after a patron was shot and killed outside the business has reopened.

Del Denby Tavern is back open after receiving a cease and desist notice while under investigation for a May 7 shooting near the bar.


Del’s attorney, Roland Cercone, said the shooting was tragic and unfortunately could have happened anywhere.

“There are other shootings in other areas, even in Hertel,” Cercone said. “We are concerned about the general safety and well-being of our city in general, but regarding its establishment, he has taken every possible measure to ensure safety, not only for his family, but also for the public and all patrons who attend.

Buffalo City Council member Joel Feroleto said one of the conditions of Del’s reopening required two New York State-licensed security guards to work.

“Part of the conditions for reopening with the Department of Permits and Inspection is to review the safety plan, making sure measures are in place,” Feroleto said.

Buffalo police are still investigating the shooting and no arrests have been made.

Over the weekend, the city shut down another business on Hertel Avenue that authorities said was operating an “illegal speakeasy.” A city spokesperson said the speakeasy was located at 1783 Hertel Avenue.

“We have never received any complaints about this,” Feroleto said. “I live very close to there and have never heard of or seen it, but my understanding is that the Buffalo Police Department was proactive and the establishment was operating without the required license and they closed the establishment with the Ministry of Permits and Inspection.

Buffalo police issued illegal orders against the owner of the speakeasy, including consuming and possessing alcohol in public places and employing an unregistered bouncer.
