I was raped by my boyfriend and secretly recorded his confession – then his lawyer said he was just “unlucky”

A woman who secretly recorded her rapist’s confession has slammed his lawyer, saying he “traumatized” and “embarrassed” her during her testimony.

Ellie Wilson, 26, was raped by Daniel McFarlane in Glasgow university between 2017 and 2018.

Fiend McFarlane was captured for the Horror Attack after Ellie recorded him admitting his heinous crimes.

He was tried and convicted at the High Court in Glasgow in 2022.

McFarlane was found guilty of two counts of rape and attempted obstruction of justice and sentenced to five years in prison.

But Ms. Wilson’s ordeal was made worse throughout the trial by McFarlane’s lawyer, Lorenzo Alonzi.

Ellie told how the Edinburgh lawyer had accused her of suffering from a personality disorder and even said her rapist was “unlucky” met her.

In his speech to the court after McFarlane’s conviction, Alonzi said the jury had erred.

He also stressed that Ellie had obtained a first-class degree, while his client’s dream of becoming a doctor had been shattered.

He added that his client “in Love with the wrong person,” that he did not belong in court and that it was “difficult not to imagine a certain sense of injustice in all this.”

In an interview with “Good Morning Britain,” Ellie said his behavior during the trial had “traumatized” her.

Ellie said: “I came out of the trial completely traumatised, I felt like a Broken Person. I was also completely exhausted physically.

“But I knew that what happened to me in court was not right and that I needed justice for what had happened because my path to justice did not end with the conviction of my rapist.

“I knew I could get justice for these defense Lawyer.”

GMB presenter Richard Madeley then asked Ellie what Mr Alonzi had said to her during the trial.

Ellie continued: “When he cross-examined me, he accused me of suffering from narcissistic personality disorder, even though I have not been diagnosed with it.

In the clip, Ellie asks him: “Don’t you understand how horrible I feel when you say, ‘I didn’t rape you,’ even though you did?”

He replies, “Ellie, we’ve already established that I did this, but the people who need to believe me, believe me. I’ll tell them the truth someday, but not today.”

Then she asks: “How do you feel about that?”

McFarlane replies: “It makes me feel good knowing I’m not in prison.”

“He made the matter up out of thin air and when the judge asked him about it, he said it was his own assessment, although of course lawyers are not authorized to make medical assessments.”

“He just made things up and kept asking me for random MenFriends asked me if I had used these men to make my tormentor jealous, but I think the worst thing for me was actually the verdict.

“After my tormentor had already been found guilty by the jury, I was told that it was an ‘injustice’ that I had graduated with a first-class degree and a master’s degree with honours while my tormentor went to prison.”

Richard Madeley then asked: “Didn’t he also say that your rapist had the ‘misfortune’ of falling in love with you?”

“It really annoyed him that he couldn’t break me.”

She replied, “Yes, he said he fell in love with the wrong person.”

She continued: “It felt personal, it really did. During the cross-examination, it got heated at some points.”

“I felt like it really annoyed him that he couldn’t break me, and I think he wanted to put me in my place.”

Lawyer fined for “inappropriate” conduct in court

Mr Alonzi was brought before the Faculty of Lawyers after Mrs Wilson complaints about his behavior.

Ellie complained that Mr Alonzi’s cross-examination was inappropriate because he attempted to elicit “evidence that she was not of good character” and “evidence relating to her past sexual behaviour”.

The faculty ruled against Mr. Alonzi, finding that his comments during the trial were “inappropriate and should not have been made in the first place.”

The Grievance Committee “unanimously” found Mr Alonzi guilty of inadequate professional conduct under the Faculty of Advocates’ 2019 Disciplinary Rules.

They said Mr Alonzi did not appear to admit wrongdoing and did not apologise to Ellie in court for his behaviour, instead focusing his remarks on the fact that he had attracted negative publicity.

It was noted that he “regretted any annoyance caused to the applicant and any behaviour perceived as discourteous towards the court”.

He was fined £2,000 and given a severe written reprimand.

Mr Alonzi was also ordered to pay Ellie an additional £1,000 in compensation for the time and effort she had spent in pursuing the complaint against him.
