Man jailed for going ahead and raping woman in Dundee after she withdrew consent

A man who continued having sex with a woman even though she wanted him to stop was sent to prison for rape.

Ryan Hush, 23, was out watching football and having a drink with friends when he first met the woman.

Hush returned to the victim’s apartment in Dundee with her roommate and her partner.

The couple initially had consensual sex, but after some time the woman wanted to stop and withdrew her consent, which was ignored.

Judge Lady Poole said: “The jury found that you went ahead and had sex with her anyway. That was rape.”

“You consumed alcohol before committing the offence, which undoubtedly impaired your judgement, but that is no excuse.

“You tried to satisfy your own sexual needs without regard for your victim.

“You raped your victim in the bedroom of her own home where she should have been safe.”

Hush, a Perth inmate, denied raping the woman on June 2 last year but was found guilty after a trial in November.

At the High Court in Edinburgh On Monday, Hush was sentenced to four years in prison.

Lady Poole said the rape had had a “profound impact” on the woman’s life.

The judge said Hush, who was 21 at the time of the offence, had shown “poor judgement” and said his “immaturity played a part”.

New guidelines for sentencing under 25s came into force Scotland in January 2022.

The Scottish Sentencing Council recommended a more “individualistic approach” to take into account the offender’s life experiences.

The changes were made to reduce recidivism by focusing on rehabilitation rather than punishment.

Lady Poole stated: “Given your professional history, supportive family, minimal criminal record, partial insight and desire to change your behaviour in the future, there are prospects for rehabilitation.”

The judge said that given the seriousness of the crime, a prison sentence was the only “appropriate” punishment.

However, she added: “However, due to mitigating circumstances, and in particular your age, the sentence I impose will be shorter than I would have imposed for a similar offence against an older person.”

In addition to the four-year prison sentence, Hush was also placed on the sex offenders’ register indefinitely.
