Court orders suspension of reinstatement of Sanusi II as Emir of Kano

Justice Ahmad Liman of the Federal High Court in Kano has issued an order staying the implementation of the amended Kano Emirate Act, 2024.

The court’s order puts the reinstatement of Muhammadu Sanusi II as Emir of Kano on hold.

According to a suit filed in court against the Kano State Government by Alhaji Aminu Bappa Dan Agundi (Sarkin Dawaki Babba), the applicant prayed for an order suspending the implementation of the new law enacted by the Kano State House of Assembly.

4 YEARS LATER … Sanusi II returns as Emir of Kano

After hearing the applicant, the Court ordered a stay of implementation and enforcement of the Kano State Emirates Council (Repeal) Law, 2024 (1445 AH).

Justice Liman ordered: “An interim order passed by this Honourable Court suspends and does not give effect to the operation of the Council of Emirates in Kano State Abolition Act, 2024 (1445 AH) as it affects all offices and establishments of all Emirates created under the provisions of the Council of Emirates in Kano State Act, 2019 (1441 AH).

“An interim injunction of this Honourable Court restraining the 5th to 8th respondents from enforcing, executing, implementing and giving effect to the Kano State Emirates Council Repeal Act, 2024.

“In the alternative to Remedy 3 above, an interim order from this Honourable Court to maintain and preserve the subject matter of the action and/or to maintain the status quo by all parties to this action pending the hearing and determination of the Plaintiff/Applicant’s motion before this Honourable Court and an order for an expedited hearing in this matter.”

It may be recalled that the Kano State House of Assembly repealed the Emirate Council Law 2019, which created four additional Emirate Councils in the state.

In the same spirit, the Governor of Kano State, Abba Yusuf, approved the amended bill, which overthrew Emir Aminu Ado Bayero and reinstated Muhammadu Sanusi II as Emir of Kano.
