Elgin man pleads guilty to distributing sexually explicit material about a child under 13 – Shaw Local

A 56-year-old Elgin man has agreed to a nine-year prison sentence if he pleads guilty to distributing sexually explicit visual content depicting a child under the age of 13, according to a news release from the Kane County District Attorney’s Office.

Associate Judge Julia Yetter accepted Daniel P. Janavich’s guilty plea to the offense, a Class X felony, the press release said.

Assistant District Attorney Ken Hudson stated in court that on October 25, 2023, the defendant used a cell phone to send another person a video showing a female child engaging in a sexual act. The defendant knew she was under 13 years old, the press release said.

The Kane County Child Exploitation Unit investigated and identified Janavich.

Mosser and Sheriff Ron Hain created the unit to investigate people who possess or distribute child pornography.

In addition to his prison sentence, Janavich must register as a sex offender for life under the Illinois Sex Offender Registration Act.

Under Illinois state law, Janavich is eligible for a day-to-day sentence. Janavich will receive credit for the 193 days he spent in the Kane County Jail.

“Child pornography is not a victimless crime,” Hudson said in the press release. “Children depicted in sexually compromising images and videos are victimized every time someone views them, even decades later.”

In the press release, Hudson also thanked the Kane County Child Exploitation Unit, Sheriff’s Office, Elgin Police Department, Illinois Attorney General’s Office, High-Tech Crimes Bureau and Internet Crimes Against Children Task Force.
