The man who drove the vehicle that collided with Treat Williams’ motorcycle on June 12, resulting in the actor’s death, has been charged with gross negligence causing death.

According to a press release from Vermont State Police, on Tuesday, after the Bennington County District Attorney’s Office completed its investigation into the accident, prosecutors requested that Vermont State Police issue a citation for charges against 35-year-old Ryan Koss. “Vermont State Police contacted Mr. Koss on Tuesday evening. He voluntarily met with police officers at Shaftsbury Barracks where the charges against him were dealt with and released,” the release said. “He is scheduled to appear for arraignment at 8:15 a.m. on September 25, 2023, in the Criminal Division of the Vermont Superior Court in Bennington.”

Williams, a prolific stage and screen actor perhaps best known for his work on the WB drama EverwoodHe was 71 years old at the time of his death. The accident is said to have occurred on Route 30 near Dorset, Vermont around 5 p.m.

Police said in a separate news release in June that the accident occurred after Koss attempted to turn left into a parking lot. “Initial investigations indicate that the element stopped, signaled a left turn and then turned into the path of a northbound 1986 Honda VT700c motorcycle operated by Williams,” the statement said. “Williams was unable to avoid a collision and was thrown from his motorcycle. He sustained serious injuries and was flown to Albany Medical Center in Albany, New York, where he was pronounced dead.”

Barry McPherson, Williams’ agent of 15 years, told PEOPLE at the time of the actor’s death: “He was a real actor. Filmmakers loved him. It has been the heart of Hollywood since the late 1970s. He was really proud of his achievement.” He was so happy with the work I gave him. He had a balanced career.
