Texas Senator Ted Cruz criticizes the judicial nominee for putting female prisoners at risk of serial rape

Republican Sen. Ted Cruz of Texas questioned U.S. Magistrate Judge Sarah Netburn about a case involving a serial child rapist during a confirmation hearing on Wednesday.

Netburn, who was nominated for a seat on the U.S. District Court for the Southern District of New York, was one of five judges who testified at the Senate Judiciary Committee hearing. Cruz began by asking Netburn whether political ideology was more important than individual rights.

“I don’t believe you, and I think this case shows that you are willing to suppress the rights of individuals to suit your political ideology,” Cruz said when Netburn claimed her political views “don’t matter at all.” “This case involves a male defendant who raped a nine-year-old boy. Was he guilty?”

“Yes, the plaintiff has pleaded guilty to this,” Netburn replied.

Cruz pointed to a case in which Justine Shelby, a biological male who identifies as a woman, filed a lawsuit to force the Bureau of Prisons to send him to a women’s prison after he was convicted of federal child pornography. Netburn decided that Shelby should be transferred to a women’s prison.

Cruz then had Netburn confirm that the transgender inmate had also pleaded guilty to raping a 17-year-old girl before questioning her about an August 2022 ruling that ordered the prison service to transfer the biologically male inmate to a women’s facility.

“This person, 6’2″, biologically male, you said a minute ago, when this man decided he was a woman, you said this person was, I wrote it down, ‘sober and completely female,'” Cruz said. “That sentence struck me as remarkable. Did this person have male genitalia?”

Netburn claimed that she was referring to the inmate being “hormonally female” and admitted that the inmate still retained male genitalia after Cruz pressed her on the matter.

“So they took a 6-foot serial rapist, a serial child rapist with male genitalia, and he said, ‘You know, I would like to be in a women’s prison,'” Cruz responded. “And her response was, ‘That sounds great to me.'”

“Let me ask you something, the other women in this prison, do they have any rights?” Cruz asked.
