Accident: A tractor parked on a road led to an accident, ₹ 36 L to the victim’s relatives | Gurgaon News

Gurgaon: Devender Chauhan (44) was returning home with three others in his car in Jhajjar when it collided with a tractor parked in the middle of the road in January 2020. He was seriously injured and later died from his injuries. Four years later, the Gurgaon Motor Accident Claims Tribunal held the driver of the tractor responsible for the accident and awarded Devender’s family compensation of Rs 36.5 lakh. On January 28, 2020, Devender went home to Luhari and Deepak village with his friends Neeraj and Sher Singh. Devender sat next to Deepak who was driving. Near a petrol pump in Rohtak, her car crashed into the tractor, which was parked negligently in the middle of the road without indicators on. Devender sustained serious injuries and was rushed to PGIMS Rohtak where he was declared dead on arrival. Deepak, Neeraj and Sher Singh also sustained injuries in the accident. An FIR was lodged on January 29 under sections 283 (danger or obstruction in public place), 337 (causing hurt by act endangering life) and 304A (causing death by negligence) of the IPC. According to Rajiv Kaushik, counsel for the petitioner, Devender was the sole breadwinner of the family and had a monthly salary of Rs 50,000. “He leaves behind his wife, who is 85% disabled, two children and his parents,” Kaushik said. Deepak Gupta, counsel for Magma HDI General Insurance Co Ltd, highlighted the delay in registering the FIR. But the court rejected the argument of delay in FIR and observed that the company could not find any violation of the insurance policy. In an order on Thursday, Chief Justice Sunil Kumar Dewan awarded Devender’s family compensation of Rs 36.5 lakh. The compensation will be paid jointly by the driver, the vehicle owner and the insurance company, it said.
