Pedestrian Accident Liability in Yonkers

Every year thousands of people are seriously injured in pedestrian accidents. Pedestrians over the age of 65 tend to be at higher risk of being involved in fatal accidents. According to the Centers for Disease Control, “Adults ages 65 and older made up about 17% of the U.S. population in 2021. However, this group was responsible for 21% of all pedestrian deaths in 2021.” Drivers should take a number of measures to prevent pedestrian accidents.

  • Drivers should slow down at intersections.
  • Drivers should use their traffic signals to inform others of their intentions.
  • Drivers should check their blind spots before turning.

Every driver has a legal obligation to exercise due care to avoid collisions. According to New York Vehicle Code 1146, all drivers must exercise due caution to avoid striking pedestrians, cyclists and pets on the roadway. If a driver fails to slow down to avoid colliding with a pedestrian, this could be the basis for a negligence claim. Several steps should be taken after any pedestrian accident.

  • Eyewitnesses should be interviewed.
  • Medical records should be obtained.
  • Traffic camera footage should be looked for.
  • An experienced pedestrian accident attorney should be contacted.

Depending on the facts of the case, liability for a pedestrian accident may extend beyond the driver. For example, the company that owns or operates a truck could potentially be held liable. Many trucks are used commercially. After an accident, it is best to seek the advice of an experienced attorney. An attorney can examine the individual facts of your case and advise you of your legal options.
