Man jailed for ‘going on’ and raping a woman in Dundee after she withdrew her consent

A man who continued to have sex with a woman after she wanted him to stop has been jailed for rape.

Ryan Hush, 23, was watching football and drinking with friends when he first met the woman.

Hush returned to the victim’s flat in Dundee with her flatmate and partner.

The couple initially had consensual sexual intercourse, but after some time the woman wanted to stop and withdrew her consent, which was ignored.

Judge Lady Poole said: “The jury concluded that you still had sex with her. That was rape.”

“You had consumed alcohol prior to the offense which undoubtedly impaired your judgment but that is no excuse.”

“You tried to satisfy your own sexual needs without regard for your victim.

“You raped your victim in the bedroom of her own home where she should have been safe.”

Hush, a Perth prisoner, had denied raping the woman on June 2 last year but was found guilty following a trial in November.

At the Hight Court in Edinburgh On Monday, Hush was sentenced to four years in prison.

Lady Poole said the rape had had a “significant impact” on the woman’s life.

The judge said Hush, who was 21 at the time of the crime, had shown “poor judgment” and said his “immaturity played a role in this.”

New sentencing guidelines for those under 25 came into effect Scotland in January 2022.

The Scottish Sentencing Council recommended a more “individualistic approach” to take into account the offender’s life experiences.

The changes were made to reduce recidivism by focusing on rehabilitation rather than punishment.

Lady Poole noted: “Given your professional history, your supportive family, the limited number of previous offenses, your partial insight and desire to change your behavior in the future, there are prospects of rehabilitation.”

The judge said a prison sentence was the only “appropriate” punishment given the seriousness of the crime.

However, she added: “However, due to extenuating circumstances and in particular your age, the prison sentence I will impose will be shorter than I would have imposed on an older person for a similar offence.”

In addition to the four-year prison sentence, Hush was also placed on the sex offenders’ register indefinitely.
