Diddy calls for sexual assault lawsuit to be dismissed

Diddy has filed a motion to dismiss a sexual assault lawsuit filed by an anonymous accuser, claiming she filed the lawsuit too late.

According to court documents obtained by HipHopDX, the embattled bad boy mogul, who “categorically denies” the allegations, argued that the “claim revival” provision of the Victims of Gender-Motivated Violence Protection Law (VGM), a New York law that preempts adult survivors Act and the Child Victim’s Act, a state law. For this reason, the claim is that, based on an analysis of the court case, the prosecutor should have filed the lawsuit by August 2021 Associated Press.

Instead of an official statement, Diddy’s publicist pointed to the paragraph in the lawsuit that directly addresses the matter.

“At the top of Plaintiff’s brief is a bold, legally irrelevant ‘trigger warning’ designed to draw attention to his salacious and depraved allegations,” it says. “This stunt is intended to highlight a baseless and time-barred lawsuit designed to cause unwanted publicity, embarrassment and financial cost to the Combs defendants so that the plaintiff can seek undeserved financial compensation from them.”

The statement continued: “Mr. Combs and his companies categorically deny the plaintiff’s decades-long allegations against them, which have already caused incalculable damage to the reputation and business of the Combs defendants even before evidence has been presented. Plaintiff cannot claim what day or time of year the alleged incident occurred, but claims to miraculously accurately remember the most sensitive details… This case should now be dismissed with prejudice to the Combs -Protecting defendants from further damage to their reputation, namely from other parties and judicial resources are wasted.”

In her lawsuit, originally filed in late 2023, the woman alleges that Diddy, then-Bad Boy President Harve Pierre and a third man raped her after she was plied with drugs and alcohol. According to her, the alleged incident occurred in 2003 when she was still in high school.

One of the woman’s lawyers responded to Diddy’s filing by saying, “At this point, no one should take anything that ‘Diddy’ or his lawyers say seriously. Today’s motion is merely a desperate attempt by Combs to evade responsibility for Ms. Doe’s allegations of gang rape and sexual assault. It will not work.”

Last month, Diddy argued that another lawsuit against him should be dismissed because he couldn’t be sued for violating laws that didn’t exist at the time.

Specifically, the motion states that at the time of the alleged attack on Joi Dickerson-Neal in 1991, some of the laws she cites in her lawsuit, including those on revenge porn and human trafficking, had not yet taken effect.

Dickerson-Neal claims that the rapper and producer drugged and raped her in the early 1990s, while also filming the act.

He denied these allegations, saying through his spokesman: “This last-minute lawsuit is an example of how a well-intentioned law (New York State’s Adult Survivors Act) can be turned on its head.” The 32-year history by Ms. Dickerson is fictional and not credible. Mr. Combs never attacked her and she blames companies that don’t exist. This is pure money grab and nothing more.”

In February, a producer named Rodney “Lil Rod” Jones accused the New York native (real name Sean Combs) of sexual harassment, drug use and threats over the course of a year.
