Diddy asks the judge to dismiss the rape charge

Sean”Diddy“Combs has asked a federal judge to dismiss a lawsuit alleging that he and two other men drugged and raped a 17-year-old girl in a New York recording studio in 2003, calling it a “false and despicable allegation” that led to The law was submitted late, RadarOnline.com have learned.

“Mr. Combs and his companies categorically deny plaintiff’s decades-old allegation against them, which has caused incalculable harm to their reputation and business condition, before any evidence has been presented,” the filing says billboard read.

“Plaintiff cannot claim what day or time of year the alleged incident occurred, but miraculously remembers other salacious details despite her alleged incapacitated state.”

The complaint, originally filed in December and amended in March, came from an unidentified woman who claimed she had been hit Harve Pierre, then president of Combs’ Bad Boy Records, in Detroit. He allegedly flew her to New York on a private jet and took her to a recording studio, where she was allegedly given drugs and alcohol and raped by Diddy, Pierre and another man.

While the window of time New York’s Adult Survivors Act offered accusers to file sexual assault complaints after the statute of limitations has expired is closed, this lawsuit was filed under New York’s Gender-Based Violence Victims Protection Act, which also extends the filing deadline.

On Friday, Diddy’s lawyers argued that “New York State law supersedes New York State law without exception,” meaning the lawsuit had to be filed earlier to be timely.

“Plaintiff cannot claim what day or time of year the alleged incident occurred, but claims to miraculously accurately remember the most sensitive details,” the lawyers wrote. “Accordingly, this case should now be dismissed with prejudice to protect the Combs defendants from further reputational damage and before further waste of party and judicial resources.”

Diddy’s defense also criticized the lawsuit for containing a “bold, legally irrelevant ‘trigger warning’ designed to draw attention to her salacious and depraved allegations” and claimed that “the original complaint’s sparse amendments make the falsehoods and incurable.” “The statement of claim, like the original lawsuit, does not contain an enforceable claim and must be dismissed.
