The U.S. Department of Justice (DOJ) has found that some of them have the highest rates of sexual victimization in the nation. From civil lawsuits and criminal cases involving abusive guards to alarming investigative findings, records show that the Illinois Department of Juvenile Justice (IDJJ) and other entities that operate prisons or facilities that house juvenile inmates have failed to maintain a culture of secrecy and concealment to establish. There were incidents that resulted in staff abuse of prisoners continuing for decades.

The lawsuits brought by Levy Konigsberg were filed pursuant to the recently amended Childhood Sexual Abuse Act, codified at 735 ILCS 5/13-202.2. The Childhood Sexual Abuse Act provides victims of this type of sexual abuse with legal avenues to seek compensation from their abusers and the institutions that enabled the abuse by extending the time during which survivors of sexual abuse can come forward and file civil lawsuits.

The 95 survivors who have filed lawsuits so far include those who suffered sexual abuse in the 1990s and in recent years. The plaintiffs, now adults, were sexually abused as children between the ages of 12 and 17. The perpetrators of the sexual abuse included correctional officers, counselors, supervisors and other employees of the Illinois Youth Center.
