In response, the U.S. Congress and most state legislatures have enacted laws and regulations regulating the recording of telephone conversations. In many cases, prior notice and consent are required from the person recording the conversation.

We conducted a comprehensive review of wiretapping laws in all 50 states, the District of Columbia, and the federal law (Electronic Communications Privacy Act). Based on this review, we created a detailed table that categorizes states into all-party consent jurisdictions and single-party consent jurisdictions. This table also includes information on penalties for violations, statutory exceptions, and the minimum notice period required in each state.
