Fatal car accidents in Michigan

Ann Arbor, MI – Accident on Stadium Avenue at Winewood Avenue claims one lifeAnn Arbor, MI – Accident on Stadium Avenue at Winewood Avenue claims one lifeDriving is notoriously risky, but when drivers take unnecessary risks, the likelihood of a serious or fatal car accident only increases. If you’ve lost a loved one at the hands of a careless or unsafe driver, it’s understandable to feel upset and devastated.

Although no amount of compensation can replace the loss of a loved one, compensation can provide you with financial stability and help you move on. In Michigan, certain surviving family members can file a wrongful death lawsuit to seek compensation. A family member must be named as a representative for the lawsuit. Michigan law allows the following relatives of the deceased to file a wrongful death lawsuit:

  • Parents of the deceased
  • Spouse of the deceased
  • Children of the deceased
  • Parents of the deceased
  • Siblings of the deceased

In addition, any person named in the deceased’s will or legally entitled to a portion of the estate, such as aunts, uncles or cousins, can file a wrongful death lawsuit, even if none of the above-named relatives is alive at the time of death.

The negligent driver responsible for the death or serious injuries of your family member in a Michigan car accident should be held accountable for his or her actions. It’s important to note that most wrongful death lawsuits are brought by grieving families seeking fair compensation for the financial hardship caused by the loss of their loved one.

If the driver’s negligence played a role in the death of your family member, you have the right to take legal action against them. A wrongful death claim could potentially entitle you to compensation for:

  • Financial and emotional impact of the loss of a loved one, including pain and suffering: This includes the mental anguish and grief that result from the sudden and traumatic loss.
  • Loss of love, support and guidance from your family member (loss of marital union): This includes the emotional and practical support your loved one would have provided.
  • Funeral and burial costs: These are the costs associated with the burial of your loved one and can be significant and unexpected.
  • Medical and health costs: If your loved one received medical treatment before death, these costs can be significant.

After being injured or losing a loved one in an accident, it’s normal to feel scared and unsure of what to do next. The emotional toll can be overwhelming, and the financial burden can add to the stress. If you’re experiencing financial difficulties, you don’t have to go through them alone.
