Creep abuses boy and then takes him to McDonald’s

Barry Donnelly, 41, mocked the 17-year-old boy at his home in Glasgow on September 12, 2022.

Donnelly first groped his frightened victim on his bed before performing a sexual act on him.

The matter arose after an after-party for Donnelly’s mother’s birthday held at a social club.

Donnelly, a former surgical assistant at the hospital, entered his bed where the boy was already sleeping.

Prosecutor Sean Docherty cross-examined Donnelly during his testimony at Glasgow Sheriff Court.

The tax officer said: ‘The boy stated that he was lying in your bed and that you put your hand down his trousers while he was sleeping.

“You put your hands in his boxer shorts and touched his genitals.

“He fell asleep and on a second occasion you took advantage of him and pulled down his sweatpants.”

Mr Docherty then described the sexual act Donnelly had performed on the boy and denied that it had taken place.

Donnelly claimed he drove the boy home later that morning and stopped at a McDonald’s along the way.

Docherty said: “The boy stated in his statement that he was still in shock in the car and doesn’t really remember saying much.”

Donnelly stated that the boy hugged him before he dropped him off.

However, the tax officer told Donnelly that when the boy returned home, he burst into tears in front of his father and claimed that he had been sexually abused.

Mr Docherty asked: “Is this a drastic change of position?”

Donnelly replied, “Yes.”

Donnelly further claimed that the boy lied to the court even though his DNA was present on his victim.

Defence lawyer Chris Broadley had previously asked his client: “Ladies and gentlemen, we have heard evidence about certain things that happened. Do you accept that any of these things happened?”

Donnelly replied, “No.”

After an hour of deliberation, the jury unanimously found Donnelly guilty of sexually abusing the boy.

After the verdict was announced, cheers and shouts of “yes” could be heard from the audience.

It turned out that Donnelly had already been convicted of theft and a traffic violation.

Sheriff Matthew Jackson KC said: “In the circumstances of such a serious offence, I refuse bail.”

The verdict has been postponed until next month pending the availability of background reports.
