‘Father makes Gandi-Gandi-Cheeze’: Uttarakhand High Court rules that exposing private body parts and showing sex films to his son is sexual harassment under POCSO

The Uttarakhand High Court recently said that a father showing his private body parts to his child and showing him sex videos is an offence under the Protection of Children from Sexual Offences (POCSO) Act. The single bench of Justice Ravindra Maithani noted that it upheld the court’s order to book the complainant father under Sections 11 and 12 of the POCSO Act for alleged sexual harassment of his son. Moreover, the state’s top court also upheld the family court’s order that the accused father has to pay INR 25,000 per month to his wife and INR 20,000 per month to his son as maintenance under Section 125 of the Criminal Procedure Code (CrPC). “The child was also examined under Section 164 of the Criminal Procedure Code. The child has stated that his father makes gandi gandi cheeze. He would show dirty videos,” the court stated. The Uttarakhand High Court grants protection to a cohabiting couple of different religions and asks them to register under the state’s UCC Act within 48 hours.
