Liability for Car Accidents in New York City

Hit-and-run accidents remain quite common in New York and the United States. According to the AAA Foundation for Traffic Safety, “recent analysis shows that both the number of hit-and-run accidents and the number of fatalities are increasing. In 2015, there were an estimated 737,100 hit-and-run accidents (NHTSA, 2016). This means that a hit-and-run accident occurs somewhere in the United States every 43 seconds.” There are a number of common causes of car accidents.

  • Speeding
  • Distraction while driving
  • Bad weather
  • Poor road conditions

Speeding remains one of the most common causes of accidents. According to Section 1180 of the New York Vehicle and Traffic Law, no person shall operate a motor vehicle faster than is reasonable or safe given the prevailing road conditions. If a driver fails to slow down to avoid a collision with another vehicle, it may be the basis for a negligence claim. There are several steps that should be taken after any car accident.

  • Eyewitnesses should be questioned.
  • Medical records should be kept.
  • A search should be carried out for surveillance material.
  • A thorough investigation should be carried out.

There is simply no excuse for a driver to strike a vehicle in their own lane. These types of accidents usually happen when drivers are distracted or driving too fast for the conditions. Anyone injured in a car accident may be able to obtain some measure of justice through a civil lawsuit. A personal injury attorney can review all of the individual facts of your case and advise you of your legal options.
