Man arrested for obstructing peace officer while trying to flee police in Cortez – The Journal

According to Cortez police, a man was arrested early on the morning of June 24 on suspicion of driving under the influence, attempting to flee and obstructing an officer.

At approximately 2:30 a.m., Officer Kadan Sharp arrived to assist Officer Vance Carver, who had stopped Brittany Killsinsight near Handy Mart, 806 S. Broadway, on suspicion of reckless driving. A male passenger left the scene of the accident on foot.

While Carver took Brittany Killsinsight to the Montezuma County Detention Center on suspicion of drunken driving, Sharp and Sgt. Kurtiss Baumgartner waited with their other passenger, Andrea Killsinsight.

Then the man who left the scene drove up in a white Chevy Silverado. Andrea Killsinsight told police his name was Shaguille Harvey.

Sharp tried to talk to Harvey about his reasons for leaving the scene of the accident, but as he approached him in the Silverado, he noticed the “overwhelming odor” of an alcoholic beverage.

When Sharp asked Harvey to get out of the vehicle, he allegedly refused, started the engine of his truck and “sped off at a high rate of speed,” nearly running over Sharp’s feet.

As Harvey drove past the officers toward South Broadway, Baumgartner threw away his spike strips, damaging a rear tire.

Harvey continued driving and nearly collided with another vehicle as he turned onto South Broadway and headed north, police said.

With Sharp on his heels, Harvey turned into the Tomahawk Motel, 728 South Broadway, and crashed into the steel fence and motel sign, then crashed into a concrete wall near the motel swimming pool.

Sharp ordered Harvey to get out of the vehicle, whose door was damaged. He knelt down but refused to lie on his stomach.

Sharp placed his hand on Harvey and again ordered him to get on the ground. When Harvey allegedly pushed into Sharp, the officer deployed his taser to subdue him.

Baumgarten arrived and helped force Harvey into his patrol car.

Harvey refused to perform voluntary roadside maneuvers and refused to take a breath test while in jail. He was then evaluated at Southwest Memorial Hospital and cleared for detention.

He was arrested on a variety of charges, including fleeing from a motor vehicle, driving without a license, reckless driving, resisting arrest and obstructing a police officer.

A preliminary hearing is scheduled for July 16 at 3 p.m. in the 22nd District Court.
