Pearl Jam guitarist Josh Klinghoffer was sued for wrongful death after allegedly hitting and killing a pedestrian with his car.

The family of Israel Sanchez47, filed a lawsuit against Klinghoffer, 44, for his alleged involvement in a traffic accident in which Sanchez was fatally injured while crossing the street in Alhambra, California, on March 18. Weekly entertainment reported on Wednesday, July 10.

According to the source, Sanchez suffered blunt trauma to the head and died hours later.

“It was a tragic accident,” said Klinghoffer’s lawyer. Andrew Brettler, to TMZ in a statement on Wednesday. “After striking this pedestrian in the intersection, Josh immediately pulled over, stopped the car, called 911 and waited for police and ambulance to arrive. He is obviously cooperating with police throughout the traffic investigation. This was a purely tragic accident.”

Prosecutors allege that Klinghoffer was behind the wheel and using a smartphone before driving toward Sanchez.

Nick Rowleya lawyer for the prosecution, issued a statement saying that Klinghoffer “should be arrested and charged with manslaughter. We have video of him on his cellphone that shows him striking and killing Israel Sanchez, a loving father, in a crosswalk.”

Rowley continued, “Israel Sanchez was on his way to the grocery store to make soup for his family and never returned home. He did everything right, watching for oncoming traffic and obeying pedestrian signs, but tragically, Mr. Klinghoffer, who was in a hurry and talking on his phone, fatally struck him from behind with a large SUV. The loss and grief the Sanchez family must now endure is immense. We will not stop until Mr. Sanchez and his family are held accountable and receive justice.”

“My father was known as a great cook, the most talented of his family, the greatest grandfather, always full of love and joy,” plaintiff Ashley Sanchez said via Weekly entertainment“His smile was so contagious. His life was taken by the carelessness of someone who wasn’t paying attention to where he was going.”
