Johnstown man allegedly stalked teenager after raping her

CAMBRIA COUNTY, Pa. (WTAJ) – A Johnstown man is facing charges for allegedly assaulting and raping a 15-year-old girl while the two worked together at a fast-food restaurant.

Shawn Borsuk, 53, is accused of sexually assaulting an underage girl he worked with at a restaurant, according to the indictment. On March 28, officers with the Ferndale County Police Department were notified that a girl, now 17, had come forward claiming she had been harassed by a former co-worker and was now being stalked by him.

The teen told cops the assaults began when she was 15 after Borsuk allegedly kissed her at work one day. She added that Borsuk allegedly texted her afterward, asking her what she thought about the kiss and that he forced himself on her at work, according to the complaint. The teen also told police, “It was like a relationship to him, but not to her.”

The teen told officers that after the kiss, Borsuk performed sexual acts on her and raped her on multiple occasions while they were working together. She added that most of these incidents happened when her boss had to leave to make deliveries. She also told officers that Borsuk continued to communicate with her even after she left the workplace.

Police noted in the indictment that Borsuk was charged in June 2023 after he allegedly performed sexual acts on the victim. However, the charges were dropped some time later because the victim was emotionally unwilling to testify. However, the charges were re-filed in July 2024 along with several others.

On May 19, officers interviewed Borsuk after he violated a PFA, and he allegedly said the relationship he had with the teen was “more than just sexual.” Officers also spoke with Borsuk’s girlfriend, who said she suspected he was still in contact with the teen because she was able to trace the phone he used and paid for by her to the teen’s current place of employment three times. According to the complaint, the woman gave officers permission to seize the phone he used and secure it as evidence.

The teenager also gave police a letter that Borsuk had left on her windshield outside her address. Police determined that Borsuk never received that letter. The letter read: “I am not stalking you or trying to scare you. I was hoping you would grow up enough to talk. (…) If there is anything that is important to you, please tell me the truth.”

When re-interviewed about the assault in 2023, the teen told police that Borsuk would give her marijuana in exchange for sexual favors. She then said he continued to stalk her even after she told him she no longer wanted to be contacted. Borsuk allegedly came to her new workplace, according to the teen and the supervisor at her new workplace.

The teen’s new boss also told officers that Borsuk once showed up with a Christmas present for her, but her boss intercepted it and saw that he was trying to give her a sex toy, the affidavit states.

In text messages to the teenager, Borsuk allegedly told her that he was hiding outside in her parents’ cabin and wanted to see her. Police also found that in a second message, Borsuk tried to claim that the teenager was blackmailing him, not that he had fondled her.

In the affidavit, police wrote: “The defendant took advantage of the situation of a misguided juvenile and enticed her into a sexual relationship in which he performed oral sex on her and forced her to perform oral sex on him, as well as having sexual intercourse with a minor juvenile under the age of consent.”

Borsuk is being held in the Cambria County Jail on bail set at 10% of $750,000. He is charged with rape, sexual assault, involuntary sexual intercourse, sexual battery, aggravated sexual assault without consent and enticement of a minor. He is also charged with assault without consent, sexual assault of a person under 16, recklessly endangering another person and harassment.
