Court rejects suspension of the audit task force appointed by President Ruto

The Supreme Court has refused to stay the Official Gazette No. 8437 of 2024, which established a Task Force to Review Human Resources in the Health Sector.

However, the court confirmed that the matter was urgent.

“The applicants are nevertheless free to apply for an interim injunction once the main application has been filed and served,” the court order states.

Three days ago, President William Ruto set up a 20-member task force to review resources in the health sector.

However, the applicants in this matter argue that the Taskforce duplicates and usurps the mandate of a statutory body, the Kenya Health Human Resource Advisory Council under Section 30 of the Health Act 2017.

Through lawyer Ochiel Dudley, the applicants argue that their application would be ineffective if even a cent of public money or a minute of public time were spent by or on behalf of the task force.

They want the court to stop all payments to the members of the task force and to seek orders prohibiting any person from convening, assisting, attending, reporting to, receiving reports from, making payments to, or facilitating the payment of public funds to the Presidential Taskforce on Addressing Human Resources for Health.

They also want the court to quash Proclamation No. 8437 of 2024 establishing the Presidential Taskforce on Addressing Human Resources.
