What you should know about the death of Dvontaye Mitchell at the Hyatt Hotel

TThe death of a black man who was detained by four security guards outside a Milwaukee hotel last week has sparked outrage in the city, with some calling the altercation “reminiscent of the killing of George Floyd.”

Dvontaye Mitchell, 43, went to the Hyatt Regency hotel in downtown Milwaukee on June 30. According to local authorities, after a heated argument with security guards that reportedly turned physical, Mitchell was forcibly escorted out and detained until police arrived. But when police arrived, Mitchell was found unconscious and pronounced dead at the scene.

Shocking cellphone footage from witnesses showing Mitchell being restrained by security guards circulated on social media and was highlighted by prominent civil rights attorney Ben Crump, who was hired by Mitchell’s family.

What the police say

In an email statement to TIME, Milwaukee police said they are investigating a death that occurred at a business in the 300 block of W. Kilbourne Avenue, but would not confirm the identity of the deceased person or the business.

The police statement said the person allegedly entered the store, “caused a disturbance” and “argued with security personnel as they escorted the person out.”

Security detained the man until police arrived at the scene, the statement said. When officers arrived, they found the man unresponsive. After life-saving measures were administered, he was pronounced dead, police said.

Police would not elaborate on what caused the disturbance that led to the incident. They said the cause of death is still under investigation, but added that it is not a criminal investigation at this time. The incident is being investigated by the Milwaukee County District Attorney’s Office, police said. The Milwaukee County Coroner’s Office is investigating the cause of death.

What the video shows

A video taken by a witness shows Mitchell being pinned to the ground by four security guards. In the video, at least one of the guards is seen kneeling on Mitchell’s back while another holds down his legs. One guard forcibly restrains Mitchell.

In the video, Mitchell can be heard screaming and saying “please” and “help” several times. A security guard can also be heard yelling at him to “stay down.”

At one point in the video, one of the security guards says to the person filming: “This is what happens when you go to the ladies’ room!”

Mitchell’s family calls for charges against security forces

Crump’s law firm said in a press release Wednesday that Mitchell’s mother believes her son suffered from a mental disorder. Crump said in the press release that the circumstances of Mitchell’s death were “disturbing and, as one witness described it, reminiscent of the killing of George Floyd.”

“It is deeply disturbing that we have lost another Black man in an altercation with security forces and raises serious concerns about the use of force, lack of accountability and lack of consideration for mental health,” Crump said in the statement.

Crump held a press conference outside the hotel in Milwaukee on Monday. He said the “excessive force” used by security guards led to the death of the “unarmed” Mitchell and demanded that charges be brought against the security guards involved in the incident. Dozens of people stood with Crump outside the hotel, some holding signs reading “Justice for Dvontaye.”

“After the George Floyd case, everyone in America should have trained their employees, especially security personnel, not to put their knees on people’s backs or necks,” Crump said during the press conference. “And if people are having trouble breathing, they should not be held in a prone position.”

Security forces suspended during ongoing investigations

A Hyatt spokesperson said in an emailed statement that Aimbridge Hospitality operates the Milwaukee hotel and is responsible for managing the hotel’s employees. The spokesperson said Hyatt knows that Aimbridge Hospitality “is still completing its investigation and, as of today, has suspended its employees involved in the incident.”

“We extend our deepest condolences to Dvontaye Mitchell’s family, all who knew and loved him, and the Milwaukee community on this tragedy,” the spokesperson said. “As the investigation continues, Hyatt is committed to supporting efforts to identify those responsible for the circumstances that led to Dvontaye Mitchell’s death.”

A spokesperson for Aimbridge Hospitality said in an emailed statement that they also extended their condolences to Mitchell’s family and loved ones.

“We continue to do everything we can to support the ongoing law enforcement investigation into this incident and have no further comment at this time,” the spokesperson said. “We remain committed to providing a safe and welcoming environment for all hotel guests and employees.”
