Client Alert: October 1, 2024 – Deadline for homeowners associations to communicate rules and agreements to owners or notify owners via online postings approaches | Shumaker, Loop & Kendrick, LLP

No later than 1 October 2024All homeowners associations in Florida must either provide complete copies of their rules and agreements to each member or post complete copies of the rules and agreements on their website and notify each member of the posting.

If an association elects to mail copies of the rules and agreements, it must send them by regular U.S. mail or by electronic notice to the address shown in the association’s official records for such notices to those owners who have consented to electronic notice.

If an association decides to post copies of the rules and agreements on its website to meet the October 1, 2024 deadline, instead of sending copies, it must notify consenting owners by mail or electronically that the rules and agreements are posted on the association’s website. The association must post a full copy of the rules and agreements, or a direct link to them, on the home page of its website, which is accessible to the association’s members.

Homeowners associations are also required to provide copies of any subsequent amendments to owners through the same means and to provide copies of the then-current rules and agreements to all buyers. Homeowners associations should include mailing copies of the rules and agreements or announcing their availability on the website as part of their procedures for new owners. Associations should also note that associations with 100 or more lots must have a website or mobile application and provide certain documents to their members by January 1, 2025.
