Suspended Assin NDC Secretary threatens legal action

Suspended Assin Central Secretary of the National Democratic Congress (NDC), Sadique Broni Yeboah, has threatened legal action against the party if his suspension is not lifted within three days.

In a letter to the party’s general secretary, Mr Yeboah’s lawyer called on the party to revoke the suspension and grant Yeboah a fair hearing.

The lawyer stressed that the party’s decision to suspend Yeboah without giving him an opportunity to present his case violates the principle of natural justice.

The statement said: “This is a clear violation of due process under Articles 48 and 49 of the party constitution and violates the principles of natural justice, namely: Audi alteram partem (hear both sides). In this respect, your decision is completely void and void from the beginning.”

Based on these and other considerations, the NDC member gave the party three days to reverse the decision or take legal action.

“Our client has instructed us to request the immediate lifting of his suspension within 3 days and to grant him a fair hearing if you deem it appropriate.”

“Please be informed that we have received strict and unconditional instructions from our client to take legal action against you if you default on this,” the letter continued.
