Dog is run over after domestic violence incident, man charged with capital crime

On June 29, 2024, Albuquerque Police were called to a domestic dispute at a residence in the 760 block of Juan Tabo Blvd. NE. The caller’s daughter was involved in the dispute with Andre Miller, a 28-year-old Albuquerque resident. According to the criminal complaint, an argument arose over having the name of his child’s mother stored in his cellphone, which sparked the original dispute at the residence.

According to the criminal complaint, a dog escaped from the apartment and ran into heavy traffic on Juan Tabo. The dog was struck by a car on Juan Tabo and died at the scene.

It should be noted that the Albuquerque Animal Control officers were not on duty at the time and it was feared that the dead dog would simply remain on the side of the road for the entire weekend. Dispatchers and Animal Control officers urgently called the Animal Control Department to finally get an animal control officer to the scene of the accident to pick up the dead dog.

When APD officers arrived on the scene, Miller decided to fight the officers to avoid arrest. The officers were able to wrestle him to the ground, and while he was doing so, Miller bit an officer on the leg like a dog.

During the investigation, another victim came forward and said Miller had also attacked and beaten him. The second victim was trying to help his daughter with the dead dog when Miller became violent towards him.

Miller was charged with probation violation, aggravated battery on a police officer, battery on a household member and assault on a person outside the household.
