Cork man released on bail for ten counts of rape of 16-year-old girl

The man arrested at Cork Airport on Sunday and charged with raping a 16-year-old girl ten times and producing child pornography was released on bail on Tuesday.

Judge Mary Dorgan ordered the defendant to be remanded in custody and set bail at 50,000 euros. 40,000 euros of this was verifiably deposited on Tuesday.

A further bail condition was an independent guarantee in the amount of 40,000 euros, of which 20,000 euros were provided by the defendant’s mother.

When it was confirmed that these arrangements had been made and he had surrendered his passport, Judge Mary Dorgan remanded him in custody on bail until the judge would order the service of the book of evidence on July 16.

He must also report to his local Garda station three days a week and must not have any direct or indirect contact with the complainant.

Detective Garda Alan Maxwell charged the man, who was 29 at the time of the alleged offences and is now nearly 33 years old.

He was charged with ten counts of rape, two counts of sexual assault, two counts of assault, four counts of production of child pornography and one count of possession of child pornography.

Det Garda Maxwell objected to bail on the grounds that the relationship between the accused and the complainant lasted from Christmas 2019 to July/August 2020.

“It is alleged that this was a relationship that was heavily based on sex and that the sexual activity took place when the injured party was heavily intoxicated or unconscious during intercourse – there is substantial evidence of this,” the detective said.

Mr Buttimer said: “I will challenge that kind of speculation – you have a complaint from the complainant and a response from the defendant.”

He added that the actual complaint came from someone other than the complainant. “I accept that the allegations are serious. That speaks for itself,” the lawyer said.
