Logan man arrested for alleged rape of 14-year-old Smithfield girl | News

LOGAN — A 41-year-old Logan man was arrested for the alleged rape of a 14-year-old Smithfield girl, according to police. Francesco Antonio Gutierrez-Moreira was booked into the Cache County Jail on Sunday.

According to an affidavit, Smithfield City Police officers received a call from the alleged victim on June 13. She claimed that Gutierrez-Moreira, a family friend, came to her home early in the morning of June 8 and raped her.

The girl explained that she called her friend to come over, but later realized she had dialed the wrong number and accidentally called Gutierrez-Moreira. She also provided DNA evidence to police.

On June 23, police questioned Gutierrez-Moreira. He admitted to receiving a phone call from the alleged victim but would not admit to raping her, according to the probable cause statement.

Police have asked a judge to hold Gutierrez-Moreira without bail because he poses a danger to the community and other children. They say he has no family in the U.S. and is a flight risk.

On Monday, prosecutors filed criminal charges against Gutierrez-Moreira, charging him with rape of a child, a first-degree felony, and sexual abuse of a child, a second-degree felony.

According to prison records, Gutierrez-Moreira is being held without bail and could face life in prison if convicted.

Arrested and accused persons are presumed innocent unless their guilt has been proven beyond a reasonable doubt in court.
