Noise reporting requirement at Loudoun Airport partially lifted

LOUDOUN COUNTY, VA — In preparation for a new Virginia state law, the Loudoun County Board of Supervisors voted last week to partially suspend the reporting requirement for homebuyers affected by noise from Dulles International Airport.

A new state law that takes effect July 1 prohibits municipalities from enforcing mandatory aircraft noise disclosure after the property title is recorded, meaning the disclosure may no longer be required for homebuyers purchasing resale properties.

Loudoun County has an Airport Impact Overlay District that designates where properties are subject to certain noise levels. Loudoun County has required developers within the overlay district to disclose noise levels to homebuyers for many years. In January 2023, this policy was updated to add “each subsequent owner” to the notifications.

However, the new state law means that Loudoun County cannot require notification of subsequent owners. The county will still be able to enforce the disclosure requirement on first-time owners of brand-new properties within the overlay district.

The county government said in a statement that it will work with the Metropolitan Washington Airports Authority, the operator of Dulles International Airport, to change the law in the 2025 session of the Virginia General Assembly to allow notifications to subsequent owners again.
