Bombay High Court grants bail to man accused of sexually abusing minor boys.

The Bombay High Court granted bail to a 33-year-old man accused of theft and sexually abusing three minor boys.

The order dated June 21 was made public on Monday. In it, the court found that there was no evidence of sexual intent in the case. A single judge bench of Justice Anil Kilor said the case relates to physical and mental abuse and granted bail to the accused Kapil Taak.

In 2021, Mr. Taak was arrested for sexual assault and charged under the Protection of Children from Sexual Assault (POCSO) Act and criminal intimidation under the Indian Penal Code. The mother of one of the minors filed a complaint against Mr. Taak and others. According to the complaint, the mother had come across a video clip that showed Mr. Taak and others attacking the children.

Advocate Sana Khan, representing Mr Taak, argued that the POCSO Act was not applicable in this case as there was no evidence of sexual abuse. The court order said, “After perusing the FIR and the allegations made therein against the applicant, prima facie there is no record to show that there was any sexual intent.”
