Man acquitted of raping his partner

Indore: The Indore district court has acquitted a 34-year-old married man accused of raping his partner, forcing her to have an abortion and threatening to kill her, a public prosecutor said on Wednesday. In the April 25 ruling, the court found that there was an agreement under which the 29-year-old woman agreed to an agreement whereby the man would stay with her and his wife alternately for seven days. Based on their complaint, an FIR was lodged at Bhawarkuan police station against the man on July 27, 2021, accused of allegedly repeatedly raping her on the pretext of marriage, forcing an abortion and threatening to kill her, an official said. The man was arrested on August 15, 2021. He spent 200 days in jail before being released on July 27, 2021. He was released on bail on March 2, 2022. Additional Sessions Judge Jaideep Singh cleared the man of the charges under IPC Sections 376 (2) after examining the facts and evidence. (n) (repeated rape of a woman) and Sections 313 (abortion of a woman freely without her consent) and 506 (criminal intimidation). The court emphasized in its ruling that the woman entered into an agreement with the man on June 15, 2021, which clearly stated that he was already married and would live with her and his wife alternately for a week. The agreement also stated that they had been in a relationship for the past two years. The judge said it was clear from the agreement that the woman and man were living together. Their physical relations were consensual and the man was married and unfit to marry her, the court found. The court acquitted the man and said, “In such circumstances, this man cannot be found guilty of rape and forced abortion.” As far as the threat to kill (the complainant woman) is concerned, there is no credible evidence in this regard.” PTI
