Suspension order: HC upholds suspension order of state power company’s general manager | Dehradun News

Dehradun: The Supreme Court (HC) has dismissed a plea filed by Praveen Tandon, General Manager (Legal) of Power Transmission Corporation of Uttarakhand Ltd (PTCUL), against his suspension order. The bench, comprising Justices Manoj Tiwari and Pankaj Purohit, refused to disregard the suspension order passed by Managing Director (MD) AK Juyal on the ground that suspension is not a punishment. Tandon was suspended in June last year after being accused of “dereliction of duty, negligence in discharge of statutory duty, indiscipline and obstruction of statutory work”. Its main argument was that the board, as the disciplinary authority, should have passed the suspension order and that the in-charge MD had no power to do so. However, a counter affidavit filed by the Director General (HR) of PTCUL alleged that the Board had delegated the authority to the MD, who, consequently, had the power to suspend the plaintiff without the prior approval of the Board. The court stressed that “no law provides that only the disciplinary authority can suspend a government official. In view of the fact that the MD has been delegated the Board’s authority to remove a Director General, the plaintiff’s grounds for challenging the suspension order were found to be untenable.” The HC also ordered payment of living allowance to the plaintiff, subject to him fulfilling the requisite conditions within a week from the date of the order.
