Charges dropped against former Metro Atlanta officer accused of unleashing K9 on unarmed man – WSB-TV Channel 2

ALPHARETTA, Ga. — The Fulton County District Attorney’s Office plans to appeal a judge’s decision after charges were dropped against a former Alpharetta police officer accused of using excessive force while throwing a K9 at an unarmed man.

Judge Robert McBurney ruled that Officer Michael Esposito’s actions that day were justified. According to the judge’s 13-page ruling, the use of the K9 dog was an act of self-defense against an unarmed man, Travis Moya.

The incident, filmed on a cellphone on July 20 and 21, took place at Moya’s home after police were called during what was described as a manic episode. The officers said Moya was not complying with their orders.

Esposito released his dog, which attacked Moya and bit him several times. Moya’s family said he was unarmed and was on the ground during the attack.
