Mötley Crüe’s Tommy Lee is accused of sexually assaulting a woman in a helicopter

A lawsuit has been filed against Tommy Lee accusing him of sexually assaulting a woman in a helicopter in 2003.

In a civil lawsuit obtained by PEOPLE, the 61-year-old Mötley Crüe drummer was accused of sexually assaulting a woman (who came forward anonymously as Jane Doe) on a helicopter flight from San Diego to Van Nuys, California, in February 2003 Lured into a ride by false pretenses by Tommy Lee’s personal helicopter pilot, David Martz.”

The plaintiff is now seeking damages for sexual assault, gender-based violence, intentional infliction of emotional distress and negligence and is requesting a jury trial, according to the lawsuit filed Dec. 15.

Representatives for Lee or his legal team did not respond to PEOPLE’s multiple requests for comment.

In the lawsuit, the plaintiff claims that she was invited to the private flight by Martz and did not know that the musician would also be on the helicopter.

According to the filing, the plaintiff met Martz because she frequently conducted business with him as a cashier, and the two eventually became friends in “late 2001 or early 2002.”

In mid-2002, Martz began inviting the woman to ride on his helicopter, which she perceived as “a friendly gesture,” according to the complaint, but she was hesitant because she had never flown in one before. During a lunch in January 2003, they agreed to organize “a short helicopter ride sometime in February.”

On the day of the tour, the plaintiff claims that pre-trip lunch plans were canceled at the last minute. In the lawsuit, she recalls that Lee was present upon arrival at the hangar where the plane was located and Martz told the plaintiff “that he had to take Lee to Van Nuys and that the trip would be no longer than 35 to 40 minutes.” would take.” and then ordered the plaintiff to jump into the helicopter.”

According to the complaint, Martz and Lee allegedly consumed alcohol, marijuana and cocaine while on board, and the pilot instructed the woman to “just relax” when she wasn’t drinking.

After the two men asked the woman to join them in the cockpit and the drummer allegedly encouraged her to “sit on his lap so she didn’t miss the view,” she felt “immense pressure” to join them and claimed that “within minutes” Lee began “groping and kissing” her.

According to the documents, the “plaintiff attempted to pull away from Lee, but he only became more forceful” and she claims Lee began “penetrating her with his fingers and attempting to force her into oral copulation.”

Martz, who died in a plane crash in 2015, is said to have “just watched the entire incident smiling” and the plaintiff stopped communicating with him after the incident.

The event “caused Plaintiff great shock, distress, humiliation, shame and guilt,” and according to the documents, she claims “Martz and Lee conspired to sexually assault other women…under the guise of going on a tour at Martz’s home.” to lure helicopters.” ”

Lee has repeatedly struggled with legal problems in the past. In 1998, during his marriage to Pamela Anderson, he served six months in prison on spousal abuse charges.

The rocker has two sons with his ex-wife – Brandon Thomas Lee, 27, and Dylan Jagger Lee, 25 – and has been married to influencer/comedian Brittany Furlan since 2019.
