Thane rape case: Court rejects bail plea of ​​doctor arrested for raping woman after promising marriage, citing evidence tampering

Thane, June 18: A court in Thane district in Maharashtra has rejected the bail application of a 32-year-old doctor who was arrested for allegedly raping a woman after promising to marry her. Granting bail during the investigation would allow evidence to be tampered with, it said.

“Therefore, in my opinion, considering the stage of investigation, the gravity of the offence and the facts of the case, no reason for granting bail is apparent,” Additional Judge Premal S. Vithalani said in the June 11 order, a copy of which was released on Tuesday. “Every bail application has to be decided keeping in view the facts and circumstances of the case. According to the prosecution, the doctor and the 27-year-old woman became friends in 2017 and he proposed to her in 2020. She approached the police in April 2024, after which a complaint was filed against him for rape and criminal intimidation. Prosecutors rejected the doctor’s bail application, claiming that he exploited the informant under false promises of marriage and forced her into sexual relations through threats. The court examined the evidence, including cell phone records and an audio recording presented by the informant’s lawyer.

“In view of the facts of the case, it is necessary to examine whether the accused deserves to be released on bail. There is no doubt that the informant consented to the physical intercourse. The accused’s lawyer has archived numerous photographs showing intimacy,” the court said. However, it is alleged that the informant gave his consent due to false promises of marriage by the accused and his threats to circulate the photos and videos of sexual acts on the Internet, the court said, adding that “such consent definitely cannot be considered as valid consent within the meaning of the law.”
