Australian farmer Wayne Green, 53, is found guilty of raping a British backpacker as the court hears how he forced her to perform sex acts while drunk

A farmer has been jailed for more than three years for raping a British backpacker who was working on his land as part of her visa.

Wayne Robert Green was found guilty of rape and obtaining a sexual act by intimidation after a three-day trial in Queensland’s Kingaroy District Court on Thursday. He was found not guilty on the assault charge.

The 53-year-old denied the allegations.

The father of three was aware his victim had no money and wanted to stay in Australia on her visa, Judge Glen Cash said, the South Burnett Times reported.

“You took advantage of that position,” Judge Cash said.

“There was no real consent from her. It caused her relationship problems and fear of men.”

The court heard how Green raped the woman while she was working on his farm in Mondure for two weeks as part of her working holiday visa.

She had to work as a farm worker for 88 days to extend her visa and found Green’s job advert on Gumtree.

The woman’s prosecutor, Christa Nicola, had previously told the court how the woman came home from the pub one evening and Green would “pay” her for oral sex.

“She was afraid that if she didn’t cooperate he would rape her,” Ms. Nicola said, adding that the woman only had $4 at the time.

The man was naked at the time and the victim was drunk.

“She felt she had no choice. He put her on the sofa, she was naked, he was naked, he was touching himself… at one point she had his penis in her mouth,” Ms Nicola said.

“He said the words ‘suck my cunt, you wanker’ and was aggressive and pushed her head down.”

In another incident, Green allegedly touched the woman’s breasts without her consent while she was in a truck with Green and a male farm worker.

However, the other man told the court he did not see Green touching her breasts while driving.

“There was a moment where we were all drunk and she was all flashing her breasts at cars,” the witness said. “I flirted with her, maybe I touched her breasts.”

He also said that he may have suckled her breast during the trip, that he was friends with the woman and that he slept with her a few times.

The man said the backpacker told him he had had oral sex with Green, but he “didn’t really ask any questions about it.”

However, three other witnesses told the court the British woman had told them she had been sexually abused by Green, with one saying she said it was “the worst time of her life”.

Two witnesses said the victim said Green had no doors in the house, walked around naked and sometimes went into the bathroom while she showered.

That made her uncomfortable and “I was afraid to be alone with him there,” said a witness.
