Sexual assault lawsuit against NFL quarterback Dak Prescott dismissed – NBC 5 Dallas-Fort Worth

A sexual assault lawsuit filed earlier this year against Dallas Cowboys quarterback Dak Prescott was dismissed on Wednesday.

In May, Dallas police said they would not press charges against Prescott because there was not enough evidence of a crime. On Wednesday, NBC 5 confirmed that a motion to dismiss the case was granted in a Collin County courtroom.

Prescott’s attorney, Levi McCathern, spoke to NBC 5 and praised Prescott for taking action after an extortion attempt and for being open with Dallas police during the investigation. He said Prescott was overjoyed and happy with the court’s ruling because he knows he did nothing wrong.

“The vindication of not only the law enforcement agencies that investigated the case, but also the court under Judge Tucker, is a great vindication for him,” McCathern said. “So we are pleased to announce that no further charges have been filed against him. We are pleased that the court did what it did today.”

McCathern called the plaintiff’s allegations a money-making scheme and said there were no allegations of illegality, misconduct or unfair play on Prescott’s part.

McCathern said a motion for sanctions against the plaintiff and her attorneys will be heard on Sept. 13 to determine whether there should be monetary penalties as a result of the frivolous lawsuit.

“I think everyone present was confused by the attempt to justify what happened here. This is literally an example of what not to do as a lawyer,” McCarthern said. “I’m angry at Mrs. Shores for making these allegations against Dak, but I’m much angrier at the lawyers who supported these false allegations in a way that was not legal.”

McCathern said he has received private apologies since the court’s decision, but believes a public apology is appropriate.

The plaintiff’s attorneys did not respond to NBC 5’s request for comment.

WOMAN CLAIMS SHE WAS SEXUALLY ASSAULTED

In March, a woman filed a police report claiming she was assaulted by Dallas Cowboys quarterback Dak Prescott seven years ago at the end of his rookie season.

In her report, the woman claimed she was sexually assaulted by Prescott in the parking lot of a Dallas strip club in 2017.

Prescott denied the woman’s accusation and filed a civil lawsuit, claiming she and her lawyers tried to extort him. According to the lawsuit, the woman and her lawyers wrote Prescott a letter stating that she would not press charges or make her demand public if he paid her $100 million.

Detectives with the Dallas Police Department investigated the woman’s statement. In May, police said the case was closed and detectives concluded there was insufficient evidence to prove a crime had been committed. The case was never turned over to the district attorney’s office or forwarded to a grand jury.

A Prosper police spokesman said the criminal investigation into Prescott’s extortion allegations was completed on May 1 and forwarded to the Collin County District Attorney’s Office with a charge of attempted theft by duress.

A grand jury will decide whether to indict the accuser.

McCathern said Wednesday that Prescott’s civil lawsuit against his accuser and her lawyers is moving forward.

“He will donate 100 percent of the proceeds to charities that support real survivors of sexual assault,” McCathern said.
