Dayton police officer received $67,000 and a positive evaluation while under criminal investigation

Setty has been on paid leave since March 2023. According to the Payroll Project, an annual analysis of local government employee salaries, his total gross compensation last year – including his more than two months of work and his more than nine months of vacation – was $105,439.

Setty’s annual performance review for 2023, which ended in February 2024, shows that he exceeded standards in teamwork, operational skills, and equipment care and use.

“Sergeant Setty was an asset to the Central Business District,” his supervisor wrote. “He has a long history of aggressive behavior in crime hot spots. His actions resulted in a decrease in crime and incivility in the areas he focused on. Sergeant Setty had limited deployments during the evaluation period and has been off duty since March 21, 2023.”

Setty’s personnel file, obtained by the Dayton Daily News, does not contain an official entry informing Setty of his leave of absence.

An attorney representing Setty in his criminal proceedings did not respond to a message seeking comment from the Dayton Daily News.

The charges against Setty stem from allegations made by several women who said Setty engaged in non-consensual sexual acts, according to investigative documents from the Ohio Attorney General’s Bureau of Criminal Investigation obtained by this news organization.

Setty was sentenced to up to three years probation after being found guilty on three counts.

The Dayton Police Department announced in a post on X (formerly Twitter) on June 3 that Setty had been placed on unpaid leave.

“The Dayton Police Department takes the allegations made against Joseph Setty very seriously,” the post said. “As this is an ongoing investigation, we will provide further updates as they become available. We thank the community for their patience and cooperation during this time.”
