Woman faces charges for falsely filing rape complaint against police officer in Ratlam

Ratlam (Madhya Pradesh): Extraordinary Court Judge Shailesh Bhadkariya ordered the initiation of proceedings against a woman who filed a false rape complaint against police officer Dinesh Kharari.

According to Additional Public Prosecutor Samarth Patidar, the woman had complained to the Women’s Police Station on September 21, 2023. She stated that she was married and worked as a security guard in Ratlam and lived in a room on rent. She reported that she had met constable Dinesh Kharari of Bajna police station, who had allegedly taken advantage of her strained relationship with her husband.

The woman accused Kharari of raping her in her house and threatening her with defamation if she revealed the assault. She further alleged that Kharari continued to rape her while threatening her. The situation escalated when her husband visited Ratlam, leading to a series of disturbing events, including her suicide attempt on September 15, 2023. After recovering, she confided in her husband, following which they initiated police action against Kharari on September 20, 2023.

Following her complaint, the police filed a case against Kharari and recorded her statement under Section 164 of the CrPC in which she repeated her allegations. However, during the trial, the woman retracted her allegations and stated that Kharari neither raped nor threatened her. Based on this retraction, the court acquitted Kharari and directed the police to file a case against the woman for giving false testimony.

Patidar stressed that the court can take action under Sections 340 and 344 of the CrPC against persons who change their statements after filing a report, thereby denying the incident and the original complaint. This judgment underscores the commitment of the judiciary to investigate false allegations and deliver justice.
